2026 Annual List of ECE Services with Licence Downgrades, Suspensions, or Cancellations for Regulatory Breaches
Why We Publish Annual Lists
Every year, OECE publishes the names of early childhood services that have had regulatory action taken against them.
We do this to support transparency, help families stay informed, and encourage both services and the regulator to improve and remain accountable to children, families, and the wider sector.
Publishing this list also provides the sector with a clearer picture of how well the regulatory system is functioning and where its limitations are becoming more visible.
Why the 2026 List Needs Extra Context
Significant political and regulatory shifts have meant that far fewer services are being formally held to account in 2026, whether through a provisional licence, suspension, or cancellation.
A Shift Toward “Lighter Touch” Regulation
Since 2024, under the Coalition Government, regulation has increasingly been framed as burdensome for providers rather than as protections for children’s care, health, safety, and education.

The Office of Early Childhood Education (OECE) noted that a higher tolerance for non‑compliance began in 2024, influenced by Minister David Seymour, well before new legislation took effect in June 2026.
The impact has been dramatic. The number of services placed on provisional or suspended licences, or closed due to non‑compliance, has fallen sharply. This doesn’t mean problems have disappeared. All it means is that the threshold for taking action and for imposing any meaningful consequence when minimum standards are breached has been significantly raised. Any fear that service providers once had of being caught operating below minimum standards has largely evaporated.

Major Regulatory Changes in 2026
In June 2026, responsibility for regulating early childhood services shifted from the Ministry of Education to a new Director of Regulation. At the same time, a new “graduated” enforcement system was introduced. This system slows down intervention and removes penalties for breaching minimum standards. Read:
Under the new rules:
- Services first receive warnings, improvement plans, or “support”. These steps replace immediate consequences such as licence downgrades.
- A licence can only be downgraded in two situations:
- When a service fails to respond to preliminary support steps (for example, a warning or improvement plan).
- When a service accumulates enforcement actions within a 12‑month window. Serious breaches that occurred even 12 months and one day before the next breach no longer count – effectively wiping the slate clean and allowing repeat offending to continue without being considered when consequences are decided.
Limited Monitoring and Full Inspections are Rare
Regular unannounced spot‑check inspections do not happen in New Zealand’s ECE sector. And from 1 September 2026, following the shift from the Ministry of Education to ERO, services will continue to be notified in advance when ERO staff plan to carry out compliance checks on behalf of the Director of Regulation. This allows providers time to prepare – organising and updating paperwork, adjusting staffing, and presenting a more polished version of practice than what occurs day‑to‑day.
Under ERO, providers will be asked to self‑assess their compliance and grade themselves against selected standards. This is a process that relies heavily on what services report about themselves rather than on what ERO staff directly observe before the provider’s own self‑assessment.
While ERO staff do conduct physical visits and produce individual evaluation reports for standalone services, centres that are part of mid‑ to large‑sized ECE organisations may never receive a physical visit. ERO selects only a small number of licences within large organisations to check, meaning many centres and home-based settings are never directly observed.
Outside of ERO’s scheduled (usually 3‑ to 5‑yearly) evaluations of how well services support children’s learning, regulatory compliance is only checked when:
- a complaint is made
- a serious incident occurs
- a service is sold and the licence must be updated for new ownership
Even then, assessments often focus on paperwork or a narrow subset of licensing criteria, rather than a full, in‑person inspection of practice. This means we simply do not know how many services may be operating below minimum standards at any given time.
Regulatory action is also not guaranteed, even when serious harm to a child or children occurs. Action may be limited or avoided because:
- the regulator defers to another agency (e.g., WorkSafe) instead of acting under ECE regulations
- the regulator has full discretion over whether to act, for example it may choose not to act on the basis of the knowing the service provider well and having a good relationship
- no relevant licensing criterion exists to support a finding of non‑compliance
- the regulator allows the service time to fix breaches before formal action begins
What This Means for Parents and Children
All of this means that the list of services published for 2026 represents only the very tip of the iceberg. It shows the small number of cases where action was taken – not the full picture of non‑compliance across the sector.
It is also notable that the services facing regulatory action tend to be smaller, lower‑resourced, community‑based centres. These providers are more likely to acknowledge their non‑compliance and less likely to challenge penalties. In contrast, very few mid‑ to large‑sized corporate chains appear on the list, even though they operate a significant share of the sector. A larger market share often brings greater political influence and a higher likelihood that regulatory decisions will be contested – which can make the regulator more cautious about taking action when it is warranted.
Parents need to know that the decline in regulatory action reflects changes in policy and enforcement, not a sudden improvement in quality or safety. It does not mean fewer problems – it simply means fewer problems result in penalties or serious consequences for the owners and operators of services.
Inspection Frequency and How Non‑Compliance Is Identified
New Zealand does not operate a “continuous compliance” model. Once an ECE service is licensed, it may go years without a full inspection unless there is a change in ownership.
Regular full compliance inspections and unannounced spot checks do not happen. When complaints are received or there is a serious incident, assessments often focus on whether a service is compliant based on its paperwork or based on a narrow set of licensing criteria rather than a full, in‑person inspection. Regulatory action is also not guaranteed, even when serious harm occurs. Action may be limited or avoided because:
- the regulator has full discretion over whether to change a service’s licence
- no relevant licensing criterion exists to support a finding of non‑compliance
- the regulator has given the service the time it wants to fix breaches so formal licensing action does not begin
- the regulator defers to another agency (e.g., WorkSafe) instead of acting under ECE regulations
Licensing Rules and Enforcement
New Zealand does not impose direct fines or financial penalties on ECE service providers and operators for non‑compliance, unlike some countries such as Australia. Instead, the Director of Regulation has only four enforcement tools of any serious nature:
- Written Direction
The service continues operating and receiving funding while addressing the issues identified. - Provisional Licence
The service continues operating and receiving funding while working toward compliance. - Suspended Licence
The service is temporarily closed and funding is withheld. To be allowed to open again on a provisional licence or regain its full licence the service must meet the conditions in the suspension notice and demonstrate improvement. - Cancelled Licence
The licence is permanently withdrawn and the service must close.
2026 List of ECE Services with Written Directions, Licence Downgrades, or Closures Due to Non‑Compliance
This list will be finalised at the end of the 2026 year. Below are the services that received a written direction or experienced a change to their licence due to non‑compliance in the first six months of 2026.
In the first six months of 2026:
- 3 services had their licences withdrawn and cancelled.
- 7 services were on a suspended licence.
- 43 services were operating on a provisional licence,
- 5 services were issued with a written direction (one service received two) requiring them to fix immediate health and safety risks within up to 10 days.
